Gifts of Intellectual Property

Featuring:
David Wheeler Newman, Esq.

Chair, Charitable Sector Practice
Mitchell Silberberg & Knupp, LLP

Program Description: The democratization of technology means that more people are able to create and transfer intellectual property, including patents, trademarks, copyrights, and royalty interests, while increased demand for these assets has increase their value dramatically. Charitable contributions of these intangible assets are subject to a surprising complex matrix of tax rules governing the tax benefits arising from those contributions. This presentation will familiarize participants with this matrix, using case studies that illustrate the special rules for copyrights created by the donor, and the opportunity for enhanced deductions arising from qualified donee income derived from exploitation of certain patents, trademarks and copyrights by the charity.
