Stepping Through the Complexities of a Bargain Sale: A Case Study By: Aydee Ferguson, CAP® Senior Director of Planned Giving, UC Davis Learn about the opportunities and obstacles of a bargain sale of real estate at UC Davis that netted over $1,500,000. This case study features a bargain sale of real estate completed over a 6-month period. This was a win-win gift for the donors and university but was not without its challenges, including a long due diligence process with final approvals coming a month before the close. Learn about the team of people involved in the gift (planned giving, real estate experts at UC Davis and UC office of the President, and local realtors) and various internal and external documents (MOU, internal agreements, purchase sales agreement, qualified appraisal form 8283) required for this successful gift. |

Blended gift proposals and how to enhance their impact by adding gift illustrations. “Cash is not king” in fundraising. Gifts of noncash assets are linked to greater organizational growth. So why is it difficult to convey why giving assets is a “better deal” for donors? We cover blended gift proposals and how to enhance their impact by adding gift illustrations that demonstrate benefits of CRT vs. Cash vs. CGA, etc. Attendees will be able to articulate the financial benefits (for donor and nonprofit) of giving noncash assets versus cash, and combinations of both. We cover developing gift illustrations, with and without software, preparing proposals, and confidently discussing them with donors and prospects. Charitable Remainder Trusts Revisited By: Karl Mill Founder/Attorney, Mill Law Center A refresher on the enduring usefulness of the charitable remainder trust – considered from the perspective of empowering charities to discuss the various potential benefits with their donors. The presentation will talk about the important and separate benefits associated with CRT (deduction + deferral + pre-tax growth), when CRTs should be used and which kind to use when (NIMCRUT vs. Flip vs. Standard), the complexities they bring in certain situations (self-dealing, UBI, etc.), and when to opt for a simpler strategy (a CGA, a life estate remainder gift). The presentation will also tackle the pros and cons of agreeing to be a trustee. The presentation will attempt to address all audiences – both the basics for those only passingly familiar with CRTs that are considering whether they are a fit for their program, and some more complex case studies and red flags for organizations that work with them often and need to know when to ask for help. The presentation will incorporate case studies to promote a free-flowing discussion and section and answer. |

Donor Advised Funds – The Swiss Army Knife of Philanthropy By: Tami Wallenstein Senior VP, Senior Philanthropic Specialist, Wells Fargo Philanthropic Services Donor Advised Funds (DAFs) have fast become a philanthropic tool for both high net worth and affluent givers. The flexibility coupled with tax benefits make DAFs a popular choice today for many who want to be more intentional and/or achieve impact with their philanthropic giving. This session will cover a broad spectrum including DAF basics, recent court cases, recent criticism and seven strategies where donors have utilized DAFs to carry out their philanthropy in a meaningful and effective way. We will also discuss “responsible DAF’ing” and how we, as advisors, can influence our donors/clients to use the DAF as intended - to get the money out into the community rather than sitting inactive. This is likely to be an evolving topic before May. |

Planned Giving Professional, Charitable Solutions & RISD An overview of real estate gifts, including due diligence, qualified appraisals and pre-arranged sales rules. Use case studies to walk through process with audience. Real estate is a gift that donors want to give but does it make sense for a charity to accept it. In evaluating this potential gift, several factors come into play. This presentation will provide an overview of the due diligence needed, as well as the qualified appraisal (e.g., common errors and recent rulings) and pre-arranged sales rules. The presentation will also touch on the liquidation process and how that plays into the overall determination of whether your charity should take this potentially rewarding risk (and how to mitigate risks through third-parties). |

Violations of the rules can bring about penalty taxes on the persons who participate in these transactions.
