Program Description:
Planned giving professionals are often required to evaluate whether a proposed contribution of an asset that is illiquid should be accepted. Illiquid assets include real property as well as interests in closely held corporations, limited liability companies, and partnerships. Before accepting a gift of this type, it is important to understand the tax and non-tax issues associated with these gifts and have a comprehensive list of procedures so that the gift can be properly analyzed. Failing to properly vet the gift can result in unexpected surprises to both the charity and the donor.

Jeffrey D. Davine, Esq. Partner Mitchell Silberberg & Knupp LLP Jeffrey is a partner in the Tax Department of the Los Angeles office of Mitchell Silberberg & Knupp LLP (MSK), where he has been practicing for 30 years. He assists in both non-profit and for-profit entities in various tax matters including matters that involve complex planned gifts. In addition, he assists clients in tax disputes involving the IRS, the CA Franchise Tax Board, and the CA Employment Development Department. Jeff specializes in taxation, with an emphasis on tax controversy with the IRS, California Franchise Tax Board, California Employment Development Department, and other state and local taxing authorities. Representation of non-profit entities and charitable gift planning. Representative Matters Successfully represented numerous clients in disputes with the IRS and California Employment Development Department concerning the classification of workers as employees versus independent contractors. Successfully represented a well-known motion picture director in a dispute with the IRS and California Franchise Tax Board. Assisted in the IRS examination of a well-known international company in the entertainment and toy manufacturing business. As an attorney for the IRS, served as lead counsel on numerous examinations and Tax Court cases against well-known business people, entertainers, and athletes. Jeffrey also previously served as a Special Assistant U.S. Attorney for the IRS. |
