Fiduciary Choices for Administration of Charitable Estates and Trusts By: Fredrick Weber, JD Counsel, ArentFox Schiff LLP Description: For gift planners and trusted advisors, educating donors about fiduciary options is almost as important as helping donors identify beneficiaries and structure their gifts. This presentation will discuss strategies for advising donors about the pros and cons of various fiduciary options for the post-death administration of estates and trusts that include gifts to charity. It will also include ideas for improving communication among donors and their families before a death occurs. Tough Charitable Giving Questions for a Lawyer By: Karl Mill, Attorney, Mill Law Center Description: Participants are encouraged to bring their any questions they may have for a charitable giving lawyer. The presentation will alternate between discussing those questions and what Karl sees as the most question types from clients, and how to think about them at a high level. The prepared topics will include: (1) Can I Sign This? The most common issues with documents charities are asked to sign.. (2) Can I Take This? A framework for thinking about different gift types and how to divide the easy gifts from the hard gifts. (3) Can I Spend This Money This Way? Dealing with purpose restrictions -- making tough calls and making changes. (4) Can I Spend This Money Now? 15 FAQs on the Legacy IRA By: Russell A. Willis III, JD, LLM, Consultant Description: The legislation extending QCDs to funding life income gifts took effect in 2023, an uptake has been strong. But there are many questions (at least fifteen) donors and charities may still be tripping over. What does "one and done" mean? Can spouses contribute to the same vehicle? What does it mean to say the annuity must be "nonassignable"? Can you limit the remainder trust to a term of years? Can the beneficiary of an inherited IRA make a "legacy" QCD? Does the full amount of the distribution count toward your RMD? Since the entire amount of the life income payout will be ordinary income, what exactly is the tax incentive? Can the remainder or residuum go to a donor advised fund or supporting org? We will explore these and (your) other questions. |
