Topic:  Estate Planning Essentials for Gift Planners

Program Description:  Curious about the probate process and the use of revocable and irrevocable trusts? Wondering what you should know about estate and gift taxes? Come learn about these as well as other estate planning topics relevant to gift planners.

Diane R. Cash, is a certified specialist in estate planning, trust and probate law (The State Bar of California Board of Legal Specialization) who has been practicing law since 1982. Ms. Cash's professional and community service includes speaking engagements about estate planning, board membership of legal non-profits (the Lawyers’ Committee for Civil Rights (1999 - 2005) and the AIDS Legal Referral Panel (1995-2000)), and serving as president of her daughter’s school’s Parent-Faculty Club (2008 to present). Ms. Cash received a Bachelor of Arts in English literature, cum laude and Phi Beta Kappa, from Pomona College in 1979, and a Juris Doctor from the University of California at Berkeley (Boalt Hall) in 1982.

Topic:  UPMIFA - One Year Later: Implications for Endowment Fund Raising and Management

Program Description:  California adopted new rules for the administration and spending of endowment funds just over one year ago. The law has created far more flexibility, but not all charitable organizations have felt comfortable taking advantage of this flexibility in challenging economic times. This session will look at challenges faced by charities in implementing the law, and provide examples of the wide variety of approaches being applied in the field. The presenters will address implications for marketing and development professionals when communicating with donors and their advisors, and implications for trustees and administrators when modifying spending and investment policies, dealing with underwater funds and receiving a clean audit. Audience examples and participation is encouraged.

Jill's practice focuses on the representation of charitable organizations in all aspects of their operations, from regulatory to transactional, and on trusts, estates and wealth transfer planning for very high net worth individuals, with a particular emphasis on planned charitable giving. She received her bachelors degree from Oberlin College, a master's degree from Harvard and her law degree from UC Berkeley. She is the immediate past president of NCPGC.

Bert Feuss is Vice President of Investments at Silicon Valley Community Foundation. He is responsible for administration of the community foundation's $1.5 billion investment portfolios and charitable trusts. Bert is also a valuable resource to staff, donors and nonprofits in developing investment policies and evaluating and structuring investment opportunities for financial and social impact. Bert served as director of professional services for Peninsula Community Foundation from 2004 to 2006, where he was responsible for asset development through professional advisors. Prior to joining the community foundation, he served 16 years at Franklin Templeton Investments as a senior vice president responsible for market research, product development and performance reporting. Bert earned his MBA from Golden Gate University and BS from University of California at Davis in economics and animal sciences. He is a board member and the secretary/treasurer for the Northern California Planned Giving Council, a volunteer conservation easement monitor for Peninsula Open Space Trust, and a past participant of the Social Enterprise Institute's program for social entrepreneurs.
