Topic:  Income Tax Fundamentals for Planned Giving Professionals

Program Description:  The Internal Revenue Code has numerous rules that relate to charitable giving. In this session you'll learn the basics of the charitable income tax deduction, including substantiation and gift acknowledgement requirements; whether and when a gift is deductible, and how much the donor can deduct; and when a donor might recognize capital gain in connection with a gift.

Rhomberg_03-11-10_primer Barbara Rhomberg is an attorney in the Office of the General Counsel of the University of California, specializing in charitable giving. She is a co-author of The Public Charity's Guide to the California Initiative Process and The Private Foundation's Guide to the California Initiative Process, and has written articles on topics ranging from gift acceptance policies to the gift tax treatment of Section 501(c)(4) contributions. Barbara Rhomberg received her B.A. from the University of California at Berkeley and earned her J.D. with distinction from Stanford Law School in 2000. Before joining the University of California, Silk, Ms. Rhomberg practiced nonprofit tax and corporate law at Adler & Colvin. She is on the Board of Directors of the Northern California Planned Giving Council.

Topic:  Accepting Gifts of Complex Assets

Program Description:  Although the great majority of gifts to charities come in the form of cash and marketable securities, there are certainly times when a donor wishes to make a gift of a more complex asset, such as real estate, a limited partnership interest, closely held stock, or valuable collectibles, such as jewelry, antiques, or a classic (or not-so-classic) automobile. Is your organization prepared to properly evaluate these gifts when offered, and then to either "look the proverbial gift horse in the mouth" or to proceed to accept what could be a valuable gift, as well as an opportunity to enhance a relationship with a great prospect for future gifts? In this session we will look at best practices for evaluating various types of complex assets as charitable gifts, and suggest some practical tips on how to end up with a win/win for the donor and the charitable organization.

Yates_pic_03-11-10 Chris Yates received his bachelors degree from Stanford University in 1981, worked in New York for two years for an economic consulting firm, then attended the University of Chicago Law School and earned his J.D. degree in 1986. Upon graduation he practiced corporate and banking law with Morrison & Foerster in Los Angeles from 1986 to 1989. In 1989 Chris left the field of law to become Associate Director of Undergraduate Admissions at Stanford University, and in 1992 he moved across the Stanford campus to the Office of Planned Giving as Associate Director. He relocated to Pasadena in 1998 to become Director of Caltech’s Office of Gift Planning. Chris moved back to Stanford in June 2003 to become the Director of its Planned Giving Office. He previously served on the board of the Northern California Planned Giving Council and was president of the Council from 1996 to 1998. He also served on the board of the National Committee on Planned Giving and was president in 2003. He currently serves on the board of the Partnership for Philanthropic Planning and is Conference Chair.
